1.1. The terms and conditions govern the purchaser’s purchase and use of Artists Affairs’ digital editions

1.2. It is taken as a fact that when a purchaser completes a purchase, s/he confirms that s/he has read and agreed to these terms and conditions and will be obligated thereto.

2. ITEMS PURCHASED.

2.1. Artists affairs is a once off purchase digital editorial magazine for which each edition features the following:

2.1.1. One African artist;

2.1.2. Six curated artworks in high resolution format;

2.1.3. A written artist biography;

2.1.4. Video profile;

2.1.5. Print at home rights.

3. DURATION.

3.1. The duration period for the Artisit to be in the Magazine is two (2) months.

4. PRICING.

4.1. All prices are listed in USD.

4.2. For international customers, the purchaser’s bank or payment provider may apply currency conversion rates at the time of purchase.

4.3. Artists Affairs is not responsible for any conversion fees or rate differences applied by the purchaser’s financial institution

4.4. Upon successful payment, the purchaser will then receive access to his/her edition by email.

4.5. The magazine price is 220USD

4.6. The magazine price may change without prior notification of the readers.

5. PAYMENT.

5.1. Artists Affairs shall issue a tax invoice, meeting the requirements of the VAT Act (RSA) in respect of the full purchase to the purchaser.

5.2. The customer shall pay the purchase price in full to Artists Affairs by direct bank deposit or transfer or inter-bank transfer of freely available funds (EFT) to Artists Affairs’ bank account specified in the tax invoice issued by Artists Affairs.

5.3. Only after receipt of the tax invoice issued by Artists Affairs shall the purchaser have proof of payment, except the one they’ll get from their banking institution.

5.4. The purchaser shall use the account number on the tax invoice as the reference number for the deposit or transfer.

5.5. The purchase price must be reflected as having been received into Artists Affairs bank account by no later than the last day of the tax invoice being made and the purchaser shall promptly provide Artists Affairs with the purchaser’s bank confirmation of the electronic funds transfer (EFT) or deposit of the invoiced amount upon purchase of their edition.

6. REFUND POLICY

6.1. Thirty (30) days money back guarantee is offered by Artists Affairs, subject to the following

conditions:

6.1.1. Refund requests must be submitted no earlier than three days after the purchaser has received their edition.

6.1.2. Refund requests must be submitted within 30 days of the purchaser’s purchase date.

6.1.3. To request a refund, the purchaser can contact Artists Affairs at [[email protected]] with the purchaser’s order details.

6.1.4. Refunds will be processed to the purchaser customer’s original payment method within 5 to 10 business days.

7. DELIVERY.

7.1. The purchaser’s edition will be delivered digitally by email immediately after payment confirmation

7.2. If the purchaser does not receive his/her edition within 24 hours of purchase, the purchaser is advised to first check his/her spam folder and to contact Artists Affairs at [[email protected]] immediately.

8. PRINT-AT-HOME RIGHTS.

8.1. The purchaser’s purchase includes print-at-home rights for personal, non-commercial use.

8.2. The purchaser may print the artworks included in his/her edition for display in his/her private home or residence.

8.3. The purchaser may, however, not:

8.3.1. Resell, distribute, or sublicence the artworks to any third party;

8.3.2. Use the artworks for commercial purposes, including advertising, merchandise, or resale;

8.3.3. Reproduce the artworks in any publication without written permission from Artists Affairs

9. PRIVACY POLICY

At Artists Affairs, accessible from artist-affairs.com, we respect your privacy and are committed to protecting your personal data.

9.1. Privacy Policy explains what data Artists Affairs collects, how it is used and the customer purchaser’s rights in relation to it.

10. DATA COLLETED BY ARTISTS AFFAIRS.

10.1. Name and email address - when the purchaser customer opt in to Artists Affairs’ editorial preview or make a purchase.

10.2. Payment information - processed securely and stored by Gumroad; Artists Affairs does not store purchaser card details.

10.3. Purchase history - To manage purchaser’s account and deliver customer purchaser’s editions.

10.4. Usage data - page visits and email engagement, to improve Artists Affairs’ communications with the purchaser.

11. How Artists Affairs use purchaser’s data.

11.1. To deliver purchaser’s purchased editions and the free editorial preview.

11.2. To send relevant email communications, including new editions and announcements to the purchaser.

11.3. To process refunds when requested.

11.4. To comply with Artists Affairs’ legal obligations.

11.5. Artists Affairs will never sell purchasers personal data, and will never share it with any party not directly involved in delivering purchaser’s Artists Affairs edition.

12. SURVIVAL OF RIGHTS.

12.1. All intellectual property rights in the artworks and editorial content remains with the Artists and Artists Affairs.

13. GOVERNING LAW.

13.1. These terms and conditions are governed by the laws of the Republic of South Africa.

13.2. Any dispute arising from the purchaser’s purchase or use of Artists Affairs edition will be subject to the jurisdiction of the South African courts.

14. CUSTOMER PURCHASER’S RIGHTS.

14.1. If the purchaser is in the EU, UK, US, or any jurisdiction with applicable data protection law, the purchaser will then have the right to access, correct, delete, restrict, or request a portable copy of his/her data, to which the response will be within 30 days.

14.2. Artists Affairs website uses cookies to track visitor behavior and to improve the purchaser’s experience.

14.3. The purchaser still has the right to disable cookies in his/her browser settings.

15. COOKIES

15.1 Artists Affairs’ website uses cookies to track visitor behavior and improve purchaser’s experience.

15.2 The purchaser may disable cookies in its browser settings.

16. DATA RETENTION.

16.1. Artists Affairs has the right to retain the purchaser’s data as long as necessary to deliver Artists Affairs’ services and to meet legal obligations.

16.2. Deletion requests are processed within 30 days, subject to legal retention requirements.

17. E-MAIL COMMUNICATION.

17.1. By opting in or purchasing, the customer consents to receive emails from Artists Affairs.

17.2. The purchaser may unsubscribe at any time using the link at the bottom of any email.

18. ELECTRONIC SIGNATURES (APPLIES TO CONTRACTED ARTISTS).

18.1. The parties agree that electronic signature shall have the same legal effect as handwritten signatures and paper documents under the Electronic Communications and Transactions Act, 2002 (‘ECTA”). And the South African common law, is applicable.

18.2. Each party consents to the use of electronic signatures, in the form of an ordinary digital signature on the signature page, in the execution and performance of these terms and conditions.

18.3. A party’s signature is only binding when electronically placed directly in the space indicated above their name and surname typed in the signature page below.

18.4. The agreement executed electronically by the parties shall be deemed valid and legally binding.
